MyMysticDay

Terms of Service

The contract between you and MyMysticDay: how an order is placed, what a subscription costs, what is delivered, what is promised, and what is not.

These terms govern your use of mymysticday.com and any purchase you make on it. Please read section 4 on the nature of the service, section 9 on subscriptions and section 11 on withdrawal before ordering — those are the three that most often matter.

1. Who you are contracting with

TrendPlus Marketing & Webentwicklung — Volodymyr Snihovyi, Danziger Straße 9, 57223 Kreuztal, Germany. Contact: support@mymysticday.com. Full details are in the imprint. In these terms, "we" and "us" mean that business and "you" means the person using the site.

2. Scope and language

These terms apply to every contract concluded through this website and to the use of the free parts of it. Conflicting or supplementary terms of your own do not become part of the contract unless we agree to them in writing. The contract language is English, and the English text is the only authoritative one; any translation we publish is offered for convenience.

The right of withdrawal page, the refund policy and the privacy policy form part of these terms. Where a product page states the scope, length or delivery window of a specific product, that statement forms part of the contract for that product.

3. Eligibility

You must be at least 18 years old, and have the legal capacity to enter into a contract, to buy a paid report or a subscription. By placing an order you confirm that you are. You must be at least 16 to create an account.

The free tools may be used without an account. This site is not directed to children; if you are under 16, please use it with the knowledge of a parent or guardian.

You must not use this site where doing so would be unlawful where you are. Some jurisdictions regulate or prohibit the commercial provision of divinatory services. Everything here is offered for entertainment and reflection, and it is your responsibility to know whether that is permitted where you live.

4. What the service is — and is not

MyMysticDay publishes astronomical calculations and written interpretive material: birth charts, transits, tarot readings, compatibility comparisons and numerology. The astronomical part is computed from standard sources and can be checked against an ephemeris. The interpretive part is symbolic material offered for reflection and entertainment.

It is not a prediction of future events, and it is not medical, psychological, psychiatric, legal, financial, tax, investment or any other professional advice. It does not diagnose anything, it does not treat anything, and it does not replace a qualified professional. No professional, therapeutic or fiduciary relationship arises between us. If a decision may materially affect your health, safety, finances, employment, family or legal rights, consult someone qualified to advise on it. Nothing on this site should be relied on as the sole basis for such a decision.

We make no claim that any interpretation is scientifically valid, and we do not present astrology or tarot as science. We promise that a report contains what its product page says it contains. We do not promise, and cannot promise, that it will be accurate about the future, that it will match your own view of your situation, that it will produce any particular outcome, feeling or result, or that another person will behave as an interpretation might suggest. Those are not defects in the product; they are the boundary of what the product is.

The disclaimer sets this out in full and forms part of these terms.

5. Free tools and fair use

Tarot draws, birth chart calculations, horoscopes, the calculators and the reference pages are provided free of charge, in the scope stated on the site at the time. Free features may carry usage limits — a number of readings, a range of dates, a number of saved items — and those limits are part of the free offer rather than a fault in it.

We may change, limit or discontinue any free feature at any time. No claim to continued availability of a free feature arises, and none of this affects a paid report you have already bought or a subscription period you have already paid for.

Because free features are provided without charge, our liability in respect of them is limited to intent and gross negligence, save for the cases in section 23 in which liability cannot be limited.

6. Your account

Sign-in uses a one-time code sent to your email address, or Google. There is no password. Keep access to your email secure: anyone who controls your inbox can reach your account, and we cannot tell the difference. Tell us promptly if you believe your account has been accessed by someone else.

You do not have to register before buying. If you check out while signed out, we create or reuse the account for the delivery email you provide and attach the order to it. This does not subscribe the address to marketing and does not authenticate the browser; access to the private account still requires the one-time code sent to that inbox.

An account is personal to you. You may not share it, sell it, or let another person use it, and you are responsible for what is done through it unless you show that you were not at fault.

You may delete your account at any time from your account settings. Deleting the account ends any subscription at the end of the period already paid for and removes your saved material; records we are required to keep for tax and commercial law are retained as described in the privacy policy.

We may suspend or terminate an account that is used unlawfully, that attacks or overloads the service, that circumvents usage limits, that abuses the refund policy as described in section 13, or that repeatedly breaches these terms. Where reasonable we will warn you first, and where we terminate without cause we refund the unused part of any period you have paid for.

7. How a contract is formed

Displaying a product on this site is an invitation to order, not a binding offer. You place a binding offer by completing the payment step in Stripe Checkout. The contract is concluded when we accept it, which happens either by our confirmation email or by delivering the report — whichever comes first. For instantly generated reports the two coincide.

Before the order button you are shown the product, its scope, the total price and the delivery window. For a subscription you are additionally shown the recurring price, the billing period, the date of the first renewal and how to cancel. You can correct entries using your browser's back button or by changing the details in the checkout form before confirming.

We store the contract text and send it to you with the order confirmation. You can also see your orders at any time under your account.

We may refuse an order where the product is unavailable, where payment cannot be authorised, where the order appears fraudulent, or where a previous order from you was charged back or refunded for abuse. If we refuse, we say so and take no payment.

8. Prices and payment

Prices are stated in US dollars and are total prices. In accordance with § 19 UStG (small business regulation) no value added tax is charged and none is shown separately.

If your card is denominated in another currency, your bank converts the amount at its own rate and may add a charge of its own. That charge is between you and your bank and is outside our control. The same applies to any charge your bank makes for a cross-border payment.

Payment is processed by Stripe. We accept the payment methods shown at checkout. Card details are handled by Stripe and never reach our servers. Payment is due at the point of order; access to a paid report or to a subscription begins when the payment is confirmed.

You may set off against our claims only with a counterclaim that is undisputed or has been established by a final court decision, and you may withhold payment only on the basis of a counterclaim arising from the same contract.

8.1 One-time access products and bundles

A Year Ahead report and a twelve-month personal transit calendar are each one-time purchases for one birth chart and the consecutive date range stated at checkout. The right attaches to the first eligible chart you open with it and is not a recurring membership. A bundle supplies the exact number and type of report credits stated on its product page; using a credit binds it to that completed report.

Downloadable PDF copies are available during an active Mystic Premium membership. A downloaded file remains on your device after membership access ends; generating a new PDF requires a currently active membership.

9. Subscriptions

Where we offer a subscription, this section applies to it in addition to the rest of these terms. If we are not currently offering one, nothing in this section takes effect.

9.1 What a subscription is

A subscription gives you access to the paid features listed on the pricing page for as long as it is active, at the price and billing period you chose. It is a right of access for a period, not a purchase of files: what is included can be adjusted as described in 9.6, and access ends when the subscription ends.

9.2 Price, billing period and renewal

The price, the billing period and the date of the first charge are shown before you order and repeated in the confirmation email. A subscription renews automatically at the end of each billing period, and the same amount is charged again, until you cancel. We say so at checkout, in the confirmation email, and here, because a recurring charge nobody expected is the single most common reason a customer and a business fall out.

For a subscription with a billing period of a year or longer, we email you a reminder before each renewal, stating the amount and the date it will be taken, in time for you to cancel first.

9.3 Trial and introductory offers

Where we offer a trial or an introductory price, the offer page and the checkout page state, before you pay: what you pay now, what you will be charged when the introductory period ends, when that first full charge falls due, and that you can cancel before then at no further cost. A trial that is not cancelled becomes a paid subscription at the standard price. That is the whole of the arrangement, and it is not hidden anywhere in it.

A trial or introductory price may be used once per person. We may decline a trial to an account, an email address or a payment method that has already had one.

9.4 Cancelling

You may cancel at any time, for any reason, from your account settings — the same number of clicks it took to subscribe, with no telephone call, no chat, no retention questionnaire you have to answer and no email to us required. Cancellation takes effect at the end of the period you have already paid for. You keep full access until then.

Cancelling stops the next charge. It is not a request for a refund of the period already running, and, except where the law gives you a refund or the refund policy promises one, the amount already paid for the current period is not refunded in part. Any report already generated and saved to your account during a paid period remains available to you after the subscription ends.

We may terminate a subscription with 30 days' notice to the end of a billing period, and immediately for good cause under section 6. In either case we refund the unused part of the period you have paid for.

9.5 Price changes

We may change the price of a subscription for future billing periods. We will tell you by email at least 30 days before the change takes effect, stating the old price, the new price and the date. The new price applies only from the next billing period after that notice. If you do not want to pay it, cancel before that date and no further amount is charged. Continuing after having been told is not treated as agreement to anything else in these terms.

9.6 Changes to what is included

We may add features to a plan at any time. We may remove or reduce a feature where there is a valid reason — a supplier withdraws, a licence ends, a feature proves unsafe or is materially misused, or the law requires it. If a removal materially reduces what you are paying for, we will tell you at least 30 days beforehand and you may terminate with effect from that date and receive back the unused part of what you have paid.

9.7 Failed payments

If a renewal payment fails, we may retry it over the following days and will tell you. If it still fails, access is suspended and the subscription ends. Reactivating means subscribing again at the price then current.

10. Delivery

Reports generated by our engine — such as the full birth chart report and the synastry report — are delivered immediately once payment is confirmed, and appear in your account and by email.

Readings written by hand — the love reading, the career reading and the compatibility report — are written by a person and are not generated by software. Each states its delivery window on its product page, currently 24 hours, counted in real hours from confirmation of payment rather than in working days, and from your having provided everything the reading needs. If we need something from you and you have not provided it, the window runs from when you do.

If a hand-written report is going to miss its stated window, we tell you before the window closes, and you may take a full refund at that point instead of waiting.

Delivery is electronic. It is your responsibility to give a working email address and to make sure our messages are not blocked; a report is also always available in your account, so a lost email is never a lost report.

11. Right of withdrawal

You have a statutory right to withdraw from a distance contract within fourteen days, without giving a reason. It applies to every consumer buying from us, wherever you live, because this contract is governed by German law and § 13 BGB defines a consumer by what they are doing rather than by where they are.

Important: for digital content delivered immediately, that right ends early once delivery has begun with your express consent and your acknowledgement that the consent ends the right. Both statements are put to you at checkout as separate boxes you have to tick, and the reading is only produced because you ticked them. For a report written by hand, the right ends when the work has been completed on the same basis.

The full instruction, including the model withdrawal form, the position for subscriptions and what you pay if you withdraw from an ongoing service part-way through, is on the right of withdrawal page and forms part of these terms.

Separately from and in addition to that statutory right, we offer a voluntary guarantee. See the refund policy. Nothing in that voluntary promise limits your statutory rights, and where the two differ, whichever is more favourable to you applies.

12. Complaints and defects

If a report is not delivered, is delivered late without notice, cannot be accessed because of a fault on our side, or materially does not contain what its product page said it would contain, tell us and we will put it right — by supplying it, by correcting it, or by refunding it. Your statutory rights in respect of defective digital products under §§ 327 ff. BGB are unaffected, and nothing in these terms shortens the periods those provisions give you.

An interpretation you disagree with is not a defect. See section 4.

13. Refund abuse and payment disputes

Our refund promise is deliberately generous, and it is written on the assumption that it is used honestly. We may refuse a voluntary — not statutory — refund, and may decline further orders, where the circumstances show that the promise is being used to obtain products without paying for them: repeated refunds across multiple orders, orders placed with different addresses or cards from the same person after refunds, or a report redistributed after a refund was taken.

If something is wrong with an order, tell us first. We answer within 24 hours on business days and we would rather refund you than argue. A payment dispute raised with your bank before you have contacted us costs us a fee whatever its outcome, and takes weeks to resolve something we can resolve the same day.

Where a chargeback is raised in respect of an order that was properly delivered and not defective, and it is upheld against us or withdrawn, we may claim from you the damage we actually suffer, including the fees the payment provider charges us for it. You are entitled to show that we suffered no damage or less than we claim. We may suspend an account with an open dispute until the dispute is resolved. Nothing here restricts your right to raise a genuine dispute with your bank, and nothing here is a charge for doing so.

14. Artificial intelligence

At the date of this version, no artificial intelligence system produces the readings, reports or interpretations sold or published on this site. The calculations are arithmetic run on our own servers, and the written material is composed by people.

If we introduce an AI-assisted feature, all of the following will apply to it, and this section is written now so that you can rely on it then. The feature will be clearly labelled where you use it, so that you always know whether you are reading something a machine generated. Output produced by such a system may be inaccurate, incomplete or internally inconsistent, and section 4 applies to it in full and with particular force: it is not advice, it is not a prediction, and it must not be relied on as the sole basis for a decision. We do not warrant that AI-assisted output is unique to you or that similar text will not be generated for someone else. Your input to such a feature will not be used to train any model, ours or a third party's. Do not enter data about your health, sexual life, religion, political views or finances, or another person's identifying details, into a free-text AI feature; if you do, you do so on your own initiative and we ask you not to.

15. Your content

Journal entries, saved readings, notes, the questions you write at checkout and any review you submit are your content. You keep every right in it.

You grant us a non-exclusive, worldwide licence to store, reproduce and process that content strictly so far as necessary to provide the service to you — to save your journal, to deliver your reading, to display your review where you asked us to publish it. The licence lasts as long as we hold the content, ends when you delete it, and covers nothing else: we do not use your content for advertising, we do not sell it, and we do not train models on it.

You confirm that content you submit is yours to submit, that it does not infringe anyone's rights, that it is not unlawful, defamatory, hateful or obscene, and that where it concerns another identifiable person you are entitled to provide it. We may remove content that breaches this, and will tell you why.

If you believe content published on this site is unlawful or infringes your rights, write to support@mymysticday.com identifying the page and the problem. We act on notices promptly, we tell the person who posted the content what we have done and why, and we will restore content removed in error.

16. Reviews

Every review is moderated before it appears. A submitted review is held in a queue, read by a person, and then either published as written or not published at all. Nothing is published automatically, and nothing is edited beyond removing a name or a private detail the reviewer did not mean to make public.

We do not buy reviews, offer anything in exchange for one, or write them ourselves. We do not suppress critical reviews: a low rating is moderated on exactly the terms a high one is, and the average shown on the reviews page is the average of everything published. A review is refused or removed only where it is unlawful, where it identifies a third party, where it is not about the thing it claims to be about, or where the reviewer asks us to remove it.

Where a review carries a verified purchase mark, that mark is set by our server because the review arrived through a private link sent to the address on a paid order, rather than by anything the reviewer typed. A review is withdrawn from publication if the purchase behind it is refunded, because the mark would otherwise say something untrue. Reviews without the mark are moderated and published on the same terms as the rest.

17. Acceptable use

You may not interfere with the service, attempt unauthorised access, scrape at a rate that burdens the servers, circumvent usage limits or paywalls, create multiple accounts to obtain repeated free allowances or trials, resell or sublicense access, or reproduce substantial parts of our original content without permission. Automated access is permitted only to the extent our robots.txt allows it.

You may not use this site, or anything obtained from it, to harass, stalk, profile or make decisions about another person, or to present a reading as a professional opinion, a diagnosis, a certification or a statement of fact about anybody.

18. Intellectual property

All content on this site — the calculation engine, the written interpretations, the card illustrations, the page text, the design and the compilation of it all — belongs to us or is used with permission, and is protected by copyright and, as to the databases behind it, by database right.

Buying a report grants you a personal, non-transferable, non-exclusive right to use that report for your own private purposes, including printing it and keeping it. It does not transfer copyright, and it does not permit republication, resale, redistribution, public performance or commercial exploitation of the report or any substantial part of it.

We do not reserve the rights in the publicly available content of this site for the purposes of text and data mining within the meaning of § 44b (3) UrhG and Article 4 (3) of Directive (EU) 2019/790, as declared machine-readably at /.well-known/tdmrep.json. Text and data mining of those pages, including their use to train machine learning models, is therefore permitted within the limits of those provisions. That permission does not extend to account areas, purchased reports or other content behind a sign-in or a private link, and it does not permit republishing our content or presenting it as someone else's. Reading, indexing, quoting and citing this site with attribution is welcome and needs no permission from us.

MyMysticDay and the MyMysticDay logo are our marks. You may refer to us by name; you may not use the marks in a way that suggests we endorse, supply or are associated with something we are not.

19. Third-party services and links

Payment runs through Stripe, sign-in may run through Google, and this site links to pages we do not control. We are not responsible for the content, availability or terms of third-party services, and your use of one is governed by that provider's terms and privacy policy. Where a third-party service fails, we will do what we reasonably can to help, but a failure entirely within a third party's sphere is not a breach by us.

20. Availability

We aim to keep the site available continuously but do not warrant uninterrupted availability. Maintenance, faults, attacks and circumstances outside our control may cause interruptions. Where an interruption prevents delivery of a report you paid for, you are entitled to delivery when service resumes or to a refund, at your choice. Where an interruption affects a subscription for a material period, we extend the period or refund it pro rata.

21. Your data and your own copies

We keep proper backups and we take the security of your material seriously. We are not, however, an archive: a report or a journal is stored for as long as your account exists and the retention periods in the privacy policy allow, and not necessarily longer. If a document matters to you, keep your own copy. You can export your data from your account at any time.

22. Force majeure

Neither of us is liable for a failure to perform caused by an event outside our reasonable control — war, natural catastrophe, epidemic, general failure of electricity or telecommunications networks, a state measure, an attack on the infrastructure we depend on, or the failure of a supplier for such a reason. Performance is suspended for as long as the event lasts. If it lasts more than 30 days, either of us may terminate the affected contract, and we refund what has been paid for and not delivered.

23. Liability

We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act, to the extent we have given a guarantee, and to the extent we have fraudulently concealed a defect.

In the case of slight negligence we are liable only for breach of an essential contractual obligation — an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely — and in that case only for the foreseeable damage typical of this kind of contract.

Any further liability is excluded. In particular, and within the limits set by the two paragraphs above, we are not liable for loss of profit, loss of an opportunity, loss of goodwill, or damage arising indirectly from the use of interpretive content. Liability for the loss of data is limited to the cost of recovering it that would have arisen had you kept proper backups in the ordinary way.

These limitations apply equally to our legal representatives, employees and anyone we engage to perform the contract, and they apply to claims in tort as well as in contract.

For the avoidance of doubt: we accept no liability for decisions you take on the basis of interpretive content, for the reasons set out in section 4 and in the disclaimer.

Claims for damages other than those in the first paragraph of this section become time-barred one year after you became aware of the circumstances giving rise to the claim, or ought to have become aware of them without gross negligence. Statutory limitation periods for defects in digital products are unaffected.

24. Your responsibility to us

If a third party brings a claim against us because of content you submitted, or because you used the service in breach of these terms or of the law, you will indemnify us against that claim and against the reasonable costs of defending it — but only to the extent that you are responsible for the breach. You are not responsible for a claim we caused, or that would have arisen anyway. We will tell you promptly about any such claim, give you the opportunity to be involved in defending it, and will not settle it without your agreement, which you will not withhold unreasonably.

25. Changes to these terms

We may change these terms where there is a valid reason, such as a change in the law, in a court's interpretation of it, in the technical or commercial conditions of the service, or in the service itself. Changes never apply retroactively to a purchase already made.

For an ongoing contract such as a subscription, we will tell you of a material change by email at least 30 days before it takes effect, and set out what is changing. You may terminate with effect from that date if you do not accept it. We do not treat silence as agreement to a material change: if you do not accept it and do not terminate, we may terminate the subscription ourselves at the end of the period and refund what is unused.

For one-off purchases, the version of these terms in force when you ordered is the version that governs your order. We keep it, and we will send you a copy on request.

26. Transfer

We may transfer this contract to another company as part of a sale or reorganisation of the business, provided your rights are not reduced by it; we will tell you first, and you may terminate a subscription with effect from that date if you would rather not continue. You may transfer your rights under this contract only with our agreement.

27. Complaints, governing law and jurisdiction

If something is wrong, write to support@mymysticday.com. We answer within 24 hours on business days. Please give us 30 days to resolve a complaint before taking any other step; almost everything is resolved in one email, and this costs you nothing and no time limit runs against you while it happens.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country in which you are habitually resident.

There is no exclusive place of jurisdiction where you are a consumer: you may sue us where you live or where we are established, and we may sue you only where you live. Where you are not a consumer, the place of jurisdiction is our registered office.

Pursuant to § 36 VSBG we are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

28. Severability

If any provision of these terms is or becomes invalid, the validity of the remaining provisions is unaffected. An invalid provision is replaced by the statutory rule that applies in its place.
